K’ómoks First Nation is one of 213 First Nations signatories to the Framework Agreement on First Nation Land Management. Through the Framework Agreement K’ómoks First Nation approved their Land Code 2016 and subsequently began governing their lands through the code.
By enacting the K’ómoks First Nation Land Code, the Nation replaced 44 sections, or over 30% of the Indian Act, enabling them to create their own laws to regain control of their lands, environment and resources.
Developing and approving the Land Code was a conscious effort to move away from the Indian Act and exercising their right to self- governance. Through Land Code, the Nation removed Canada’s hold over decision-making on their lands, and they have broad powers related to the use, management, and protection of their land. This includes creating and prosecuting offences, assigning penalties, and appointing a Justice of the Peace to enforce their laws.

2024: Breaking ground with historic appointment of a Justice of the Peace
K’ómoks First Nation will celebrate the appointment of their first Justice of the Peace in December 2024 – the first Land Code Nation to achieve this milestone.
This is a significant step in expressing their right to self-governance. The appointment strengthens K’ómoks First Nation’s role in overseeing justice within the community, making sure legal processes reflect the community’s values, needs, and traditions, while also aligning with the broader Canadian justice system.
